Morse Micro Online Community Terms of Service

Effective Date: 1 August 2024

These Terms of Service (“Terms”) govern your use of the Internet forum at https://community.morsemicro.com (the “Forum”). The Forum is operated by Morse Micro Pty Ltd (“Morse Micro”, “we”, “our”, “us”).

By accessing or using the Forum, you agree to these Terms. If you do not agree, you may not use the Forum.

Morse Micro may offer other products and services under different terms. These Terms apply only to use of the Forum.

1. Important Terms

These Terms include important provisions that affect your rights and responsibilities, including:

  • Disclaimers in Section 10

  • Limits on Morse Micro’s liability in Section 11

  • Your responsibility to indemnify Morse Micro in Section 9

  • Rules on how disputes will be handled in Section 14

2. Permission to Use the Forum

Subject to these Terms, Morse Micro grants you permission to use the Forum. Everyone must agree to these Terms to use the Forum.

3. Conditions of Use

Your permission to use the Forum is subject to the following conditions:

  • You must be at least 16 years old.

  • You may no longer use the Forum if we notify you directly that you may not.

  • You must comply with the Acceptable Use and Content Standards below.

4. Acceptable Use

You agree not to:

  • Break the law or encourage unlawful conduct.

  • Access or attempt to access another user’s account without permission.

  • Buy, sell, or trade in usernames or other identifiers.

  • Send spam, advertisements, or chain letters through the Forum.

  • Harvest personal data or use the Forum for commercial mailing lists.

  • Automate access (except for indexing by public search engines).

  • Misrepresent your affiliation with Morse Micro or others.

  • Circumvent security or access controls.

  • Overload the Forum’s infrastructure with unreasonable requests.

  • Impersonate others.

  • Assist others in violating these Terms.

5. Content Standards

You may not post content that:

  • Is illegal, offensive, harassing, or harmful.

  • Infringes intellectual property rights or violates confidentiality obligations.

  • Contains malware or malicious code.

  • Discloses confidential or personal information without permission.

  • Is merely a placeholder to reserve a name or address.

6. Enforcement

Morse Micro may investigate and enforce violations of these Terms to the fullest extent permitted by law. We may:

  • Remove, redact, or modify content.

  • Restrict, suspend, or close accounts.

  • Cooperate with law enforcement.

7. Accounts

Some Forum features require an account. When you create an account, you must:

  • Provide a valid email address and keep it up to date.

  • Use a secure password and keep it confidential.

  • Be responsible for all actions taken using your account until you close it or notify us of compromise.

You may close your account at any time by contacting community@morsemicro.com.

8. Your Content

You retain ownership of content you submit to the Forum. By posting, you grant Morse Micro a non-exclusive, worldwide licence to host, display, and distribute your content within the Forum.

This licence ends when your content is removed from the Forum, except for copies in backups or where others have reused your content under their own licences (e.g. Creative Commons).

You are solely responsible for the content you submit. Morse Micro is not responsible for others’ misuse of your content.

9. Your Responsibility

You agree to indemnify and hold harmless Morse Micro against legal claims and expenses arising from your use of the Forum or your violation of these Terms.

10. Disclaimers

The Forum and its content are provided “as is.” To the fullest extent permitted by law, Morse Micro makes no warranties, express or implied, regarding the Forum.

The Forum may link to or integrate with third-party sites. Morse Micro is not responsible for those sites or their content.

11. Limits on Liability

To the fullest extent permitted by law:

  • Morse Micro and its suppliers will not be liable for indirect, incidental, or unforeseeable damages.

  • Total liability for any claim relating to the Forum will not exceed AUD $100.

12. Feedback

We welcome feedback and suggestions. By submitting feedback, you grant Morse Micro the right to use it without restriction or obligation to you.

13. Termination

Either you or Morse Micro may terminate this agreement at any time. Upon termination, your right to use the Forum ends.

The following survive termination: Your Content (Section 8), Responsibility (Section 9), Disclaimers (Section 10), Limits on Liability (Section 11), and General Terms (Section 15).

14. Disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

You agree that disputes will be resolved in the courts of Sydney, New South Wales, Australia.

If you are located outside Australia, mandatory consumer protection laws in your home country may also apply.

15. General Terms

  • If a provision is unenforceable, it will be modified to the minimum extent necessary or severed.

  • You may not assign these Terms without our consent. We may assign these Terms to an affiliate or successor.

  • Failure to enforce any part of these Terms is not a waiver of our rights.

  • These Terms are the entire agreement between you and Morse Micro about use of the Forum.

17. Changes
